Harrassment and Victimisation
Sections 26 and 27 of the Equality Act pertain to harassment and victimisation.
An employer has an obligation to protect their employees from harassment in relation to a protected characteristic (including disability) which might violate dignity or “create an intimidating, hostile, degrading, humiliating or offensive environment” for that employee. (Equality Act, Section 26)
An employer also has an obligation to protect their employees from victimisation (Section 27). This section protects an employee who takes action against an employer in the form of a claim or allegation under the Act. It protects by outlining that a person should not be treated less favourably because they have taken action under the Act.
